Introduction
Zenith Health Technologies, Inc. (“Zenith Health,” “Zenith,” “We” or “Us”) hold privacy as a core tenet of our company: we respect your privacy and are committed to protecting it through our compliance with this policy.
This policy describes the types of information we may collect from you or that you may provide when you visit the website located at www.zenithhealth.io (the “Site”), web application located at www.zenithhealth.app (the “App”) and other technologies (collectively, the “Service”), and our practices for collecting, using, maintaining, protecting, and disclosing that information. Capitalized terms not defined in this privacy policy shall have the meaning set forth in our Terms of Use.
This policy applies to information we collect and/or receive when you access and/or use the Service, and otherwise interact with us, including but not limited to, via email, text, and other means.
It does not apply to information collected by us offline or through any other means, including on any other website operated by Zenith or any third party (including our affiliates or subsidiaries); any third party (including our affiliates or subsidiaries), including through any application or content that may link to or be accessible from or through the Service.
Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. You should not use the Service and you may not accept this Policy if you are not of a legal age to form a binding contract with Zenith Health. By visiting the Site and/or accessing the Service, you agree to this Policy. If you do not agree to any of the terms in this Privacy Policy, you should not access the Site or use the Service. This policy may change from time to time (see Modifications to the Privacy Policy). Your continued use of this Service after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.
Information we collect
Information we collect from you
Certain areas and features of Site are available to you without registration or the need to provide to us any information. However, other features of the Site or the Service may require registration via account creation, which involves provision to Zenith Health of the Account Information.
We collect personal information about you from you directly when you fill out forms on the Site or the Service and certain details automatically when you navigate through our Site. This personal information includes identifying information such as name, address, email address, or phone number.
Account Information
You will be required to create an account with Zenith Health in order to access and use certain features of the Service. If you choose to register for the Service, you agree to provide and maintain true, accurate, current and complete information for your account. Account Information includes, as applicable or permitted under law, items such as email address, telephone number, contact preferences, device identifiers, or IP address.
Discover / "Ask Pearl"
We collect information from your Inputs to the Ask Pearl tool. This information includes the content of your search terms, which may, if you choose, include identifying information. Optionally, you may also provide personal information used to provide more specific search results through the Ask Pearl tool, by completing any of the optional profile fields within your account relating to your pregnancy status, health history, or personal demographics.
Zenith Health Evidence Project
If you choose to participate in the Pregnancy Evidence Project, you may choose to provide us with: (i) information about your health, such as information about your pregnancy symptoms or quality of life; (ii) other information you’ve shared with third parties, including medical professionals, pregnancy support team and/or researchers; and (iii) data from surveys or wearable technologies (collectively, “Self-Reported Data”). You may also choose to provide us with an authorization to enable us to request access to copies of your health information and medical records from your healthcare provider(s) through the “right of access” granted to you under HIPAA (the “Medical Records”), as well as through online portal accounts that may be made available to you by some healthcare providers or health plans. In providing such authorization, you will provide us with your name, prior names or maiden names, date of birth, addresses, phone number(s), gender, race or ethnicity, and information about your doctors and healthcare providers.
We collect personal information about you, including Medical Records, using one or more of the following processes:
- Asking you to identify the doctors, medical providers and institutions where you have received care;
- If applicable, having you connect to the online portal hosted by your healthcare provider(s) or health plan(s) to obtain any medical or health plan records that can be accessed by Zenith Health for the Pregnancy Evidence Project (you will need to enter your specific portal credentials; for example, portal username and password) for the relevant healthcare provider or health plan;
- If applicable, sending a request for your Medical Records to healthcare data networks, other medical and health-related information databases, and other publicly available data sources;
- Sending a request for your Medical Records to another medical provider that is identified in your Medical Records (for example, sending a request for a copy of a lab test result from the laboratory identified in the doctor’s record);
- Other instances where you either choose to provide us with certain information or have us collect certain information on your behalf.
Zenith consolidates and standardizes Medical Records and Self-Reported Data (collectively, “Patient Information”) and transforms them into digital data. Your Patient Information may contain sensitive information about you.
From time to time we may request other personal information to provide you with other benefits of the Service. In all such instances, you will be given the opportunity to provide or to decline to provide that information, and it will be used only for the stated purpose.
Information we collect through automatic data collection techniques
As you navigate through and interact with our Site and Service, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:
- Details of your visits to our Site or Service, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Service;
- Information about your computer and internet connection, including your IP address, operating system, and browser type.
The information we collect automatically helps us to improve our Site and to deliver a better and more personalized Service, including by enabling us to:
- Estimate our audience size and usage patterns;
- Improve the Service by providing support and troubleshooting resolution;
- Store information about your preferences, allowing us to customize our Site or Service according to your individual interest or designations;
- Speed up your searches and/or improve your search results when using the Service;
- Recognize you when you return to our Site or Service.
The technologies we use for this automatic data collection may include:
- Cookies (or browser cookies): A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Website. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Website.
- Web Beacons: Pages of our Site, aspects of our Service, and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an email and for other related Site statistics (for example, recording the popularity of certain content and verifying system and server integrity).
Some web browsers permit you to broadcast a signal to websites and online services indicating a preference that they “do not track” your online activities. At this time, we do not honor such signals, and we do not modify what information we collect or how we use that information based upon whether such a signal is broadcast or received by us.
Our use of personal information
We may use information that we collect about you or that you provide to us, including any personal information:
- To present our Site and Services to you;
- To provide you with information, products, or services that you request from us;
- To create aggregated, de-identified data insights for research purposes;
- To fulfill any other purpose for which you provide it;
- To provide you with notices about your account;

Disclosure of personal information
Zenith Health may anonymize and aggregate personal information and disclose such data only in a non-personally identifiable manner to:
- Organizations approved by Zenith Health that conduct approved research projects into pregnancy and maternal health; and
- Users of the Service for purposes of comparison of their personal health situation relative to the broader community.
Access to your Account Information and any other personal information you provide is strictly restricted and used in accordance with specific internal procedures and safeguards governing access, in order to operate, develop or improve the Service. These individuals have been selected in accordance with our security policies and practices and are bound by confidentiality obligations. They may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.
We may share your data with third-party vendors, service providers, contractors, or agents ("third parties") who perform services for us or on our behalf and require access to such information to do that work. We have contracts in place with our third parties, which are designed to help safeguard your personal information.
We may also share your information:
- As directed by you or with your consent;
- To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which personal information held by us about the users of the Site or the Service is among the assets transferred;
- To our affiliates, subsidiaries, or parent company;
- To enforce any agreement, including any applicable terms of use;
- To establish or exercise our right to defend against legal claims;
- To law enforcement and other government authorities such as legislatures, courts, agencies and litigants if we reasonably believe that such action is necessary to: (a) comply with the law and the reasonable requests of governmental authorities; (b) comply with legal process; (c) respond to requests from public or government authorities, including public or government authorities outside your country of residence; (d) protect the security or integrity of the Services’s information systems; and/or (e) exercise or protect our rights, privacy, safety or those of affiliates, clients, you or others; and
- If we reasonably believe disclosure is necessary or appropriate to protect the rights, property, or safety of Zenith Health, our customers, or others.
Data retention
We will retain your personal information only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your personal information to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our legal agreements and policies.
Deleting your data
Your data is yours. You can request to remove it anytime you want. Unless we are required to maintain your data for legal purposes, when you submit to us a request to delete your account for the Service, your personal information will be permanently expunged from our primary production servers and further access to your account will not be possible. If you would like to delete your personal information, you can do so by contacting us at support@zenithhealth.io.
Data security
Unfortunately, the transmission of information via the internet is never completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Site or Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site or Services. We protect your personal data through a combination of controls and best practices, however no data protection procedures are ever completely secure.
We use a combination of encryption techniques and authentication procedures, among others, to maintain the security of your online session and to protect Zenith Health accounts and systems from unauthorized access. Our servers are maintained in a facility that is protected by industry best practices and commercially reasonable security precautions.
When you register for the Service, the App requires a password from you for your privacy and security. You should maintain the confidentiality of your password. Zenith Health transmits information such as your account information for the App securely.
Email communication
From time to time we may provide our registered account holders with email alerts or email newsletters. You have the ability to opt-out of receiving our promotional emails and to terminate any newsletter subscriptions by following the instructions in the emails to unsubscribe. Opting out in this manner will not end transmission of service-related emails, such as email alerts concerning your outstanding actions or other use of the Service.
Third-party websites
Our Site or Service may contain links or references to other websites outside of our control. Please be aware that this Privacy Policy does not apply to third-party websites. Zenith Health does not control and is not responsible for what third parties do with your personal information. Please exercise caution and consult the privacy policies posted on each third-party website for further information.
Children under 18 years of age
Our Site and Services are not intended for use by children under the age of 18 without parental consent.
If we learn that we have collected personal information from a minor under the age of 18 without verification of consent from a parent or guardian, we will delete that information. If you believe that we have impermissibly collected personal information from or about a minor under the age of 18, or if your parent or legal guardian wishes to review your personal information, please contact us at privacy@zenithhealth.io.
California Resident Privacy Rights
Residents of the State of California have the right to request from certain businesses with whom the California resident has an established business relationship a list of all third parties to which the business, during the immediately preceding calendar year, has disclosed certain personally identifiable information for direct marketing purposes. We are only required to respond to a customer request once during any calendar year. To obtain this information, you should send a written request to privacy@zenithhealth.io with the subject heading “California Privacy Rights.” In your request, please attest to the fact that you are a California resident and provide a current California address for our response. Please be aware that not all information sharing is covered by the California Privacy Rights requirements and only information on covered sharing will be included in our response.
Nevada Resident Privacy Rights
If you are a Nevada resident, you have the right to opt out of the sale of certain personal information, including your name and mailing address, to third parties. As of the date of this privacy policy, we do not sell any personal information to any third party. If that were to change in the future, we will update this privacy policy.
Geographic Restrictions
Our servers are located in the United States. If you are accessing our Services from outside the United States, please be aware that your information may be transferred to, stored, and processed by us in our facilities and by those third parties with whom we may share your personal information in the United States.
Modifications to the Privacy Policy
We update this Privacy Policy periodically, and it is our policy to post any changes we make to our Privacy Policy on this page. The date the Privacy Policy was last revised is marked at the top of this page. Changes take effect immediately upon posting. Your continued use of the Site and the Services will be deemed to be your agreement that your personal information may be used in accordance with any changes. If you do not agree with the changes, then you should stop using the Site and the Services and notify us that you do not want your personal information used in accordance with the changes. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Site and this Privacy Policy to check for any changes.
